These Terms and Conditions (“Terms”) govern the use of the website and the purchase of products offered by UbyU Originals a brand engaged in the creation, customization, and distribution of lifestyle merchandise and apparel (hereinafter referred to as the  “the Brand”, “we”, “our”, or “us”). By accessing the website and/or placing an order, the customer (hereinafter referred to as the  “you”, “your”, or “the Customer”) agrees to be bound by these Terms.

These Terms constitute a legally binding agreement between the Brand and the Customer, enforceable under applicable Indian law. By accessing, browsing, or placing an order through our website, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, along with our Privacy Policy and any other policies communicated through the platform.

S&S ELECTRO DEVICE is a registered partnership firm operating under the applicable laws of India. All business activities, including product development, order processing, dispatch, and customer service, are conducted under the legal and operational framework of the said partnership. The firm functions as the principal entity behind the brand “UbyU Originals,” and holds all associated rights, liabilities, and obligations as per the prevailing statutes.

1. GENERAL

1.1. UbyU Originals is a brand that designs and markets original and curated merchandise, including but not limited to apparel, home accessories, and custom lifestyle goods. All such products are offered for sale exclusively under the brand name UbyU Originals.

1.2. All production, packaging, quality assurance, and dispatch operations are undertaken and managed internally or via our authorised operational units, as part of a consolidated supply and distribution framework.

1.3. All communications, labelling, branding, and fulfilment activities are conducted solely under the identity of UbyU Originals, which remains the sole party responsible for any contractual obligations towards the Customer.

2. ORDER CONFIRMATION AND FULFILMENT

2.1. All orders placed by Customers are subject to confirmation and acceptance by the Company. The Brand reserves the right to cancel or reject any order, in full or in part, for reasons including, but not limited to, unavailability of stock, inaccuracies in pricing or product details, or suspicion of fraudulent activity.

2.2. The Brand shall not be held liable for any delay in delivery or order processing arising due to force majeure events, third-party logistics disruptions, or inaccurate customer information provided during checkout.

3. RETURNS, EXCHANGES AND DAMAGE POLICY

3.1. The Brand follows a strict no-return and no-exchange policy, except in cases where the product delivered is demonstrably damaged or defective as a direct result of the Company's production or dispatch process.

3.2 Claims for replacement will only be considered if one or more of the following material defects are present upon delivery:

·         Physical damage to the product (e.g., tears, dents, or cracks);

·         Material defects in print, design, or structural integrity;

·         Dispatch of an incorrect product not matching the order specifications;

·         Serious compromise in product quality attributable to handling or packaging.

3.3. The following issues shall not qualify for replacement or refund under any circumstances:

·         Colour deviations resulting from screen brightness or digital mockups;

·         Minor alignment or aesthetic inconsistencies inherent to handcrafted or digitally printed products;

·         Incorrect size ordered by the Customer;

·         Subjective dissatisfaction with product style or design.

4. CLAIM PROCEDURE FOR DEFECTIVE PRODUCTS

4.1 Customers seeking redress under Clause 3 must submit a claim within 48 (forty-eight) hours from the time of delivery.

4.2. The claim must be submitted via official communication channels and must include:

  • A complete and continuous unboxing video showing the parcel being opened from its original sealed state;
  • High-resolution photographs clearly highlighting the claimed defect(s);
  • Order confirmation details and proof of identity.

4.3. Failure to provide either the unboxing video or the photographic evidence will render the claim ineligible for processing.

4.4. Upon receipt of a valid claim, the Company shall initiate an internal investigation, which may take up to 10 (ten) business days. The outcome of this process shall be final and binding.

4.5. If the defect is confirmed, the Customer will be offered:

  • A replacement of the same or equivalent product, subject to stock availability; or
  • A non-refundable store credit of equivalent value, redeemable only on the official website of UbyU Originals.

Note: No monetary refunds shall be issued under any circumstances.

5. SIZE AND FIT POLICY

5.1. Each product page includes detailed and standardised size charts. The onus of reviewing and selecting the appropriate size lies solely with the Customer.

5.2. Claims arising from issues related to size, fit, or measurements shall not be entertained. Customers are advised to consult the size guide diligently before placing an order.

6. COLOUR AND DESIGN REPRESENTATION DISCLAIMER

All product images and previews displayed on the website are indicative and generated using representative visual mockups. While we make every effort to ensure the closest possible resemblance, minor variations in colour, tone, alignment, or print saturation may occur due to differences in screen settings, lighting, and the nature of production.

6.2. Such deviations are industry-standard and shall not be deemed to constitute defects or grounds for complaint.

7.  PRIVACY POLICY

This Privacy Policy outlines how UbyU Originals (“we”, “our”, or “us”) collects, uses, and protects any personal information provided by users (“you”, “your”, or “Customer”) when interacting with our website or purchasing our products.

We are committed to ensuring that your privacy is protected. Should we request certain information by which you can be identified, it will only be used in accordance with this Privacy Policy.

We may revise this Policy at any time. We encourage you to check this page periodically for any changes. Continued use of the website constitutes your acceptance of such changes.

7.1 Information We May Collect

We may collect the following information for order processing, communication, and customer experience enhancement:

  • Name
  • Contact details including email address and phone number
  • Shipping and billing address
  • Demographic information such as pin code, preferences, and interests (if required)
  • Other information relevant to offers, surveys, or service improvement

7.4.2 Customers acknowledge that these service arrangements form part of the Brand’s internal operational model and do not create any privity of contract, disclosure obligations, or liability between the Customer and the engaged third parties.

7.5 Legal Disclosure

We may disclose your personal information if required by law or in response to valid legal requests.

 8. LIMITATION OF LIABILITY

8.1. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from:

  • Delays in delivery beyond the estimated time;
  • Use or misuse of the product by the Customer;
  • Third-party interference, including courier negligence;
  • Data inaccuracies or omissions on part of the Customer during order placement.

8.2.  In any case, the Company’s total liability shall be limited to the amount paid by the Customer for the specific order giving rise to such claim.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1. These Terms shall be governed and construed in accordance with the laws of India.

9.2. Any disputes, controversies, or claims arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Delhi, subject to the preliminary obligation of both parties to attempt amicable resolution through mediation or conciliation.

10.3. In the event amicable settlement fails, disputes shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The venue of arbitration shall be Delhi , and proceedings shall be conducted in English/Hindi.

10. AMENDMENTS TO THESE TERMS

10.1. The Brand reserves the right to amend, modify, or revise these Terms at any time without prior notice. The revised Terms shall be deemed effective from the date of their publication on the official website.

10.2. Continued use of the website after such changes implies deemed acceptance of the revised Terms.
